East Hampton Town: 700 square feet, the Fire Marshal, and a 14 day limit
The Town's Special Event Applications page states the trigger. A tent of 700 square feet or more at a residence needs a separate Tent Permit Application to the Fire Marshal. Any tent on commercial or public property needs one regardless of size. Section 151-5(A)(20) of Chapter 151 makes the tent application a separate filing from the special event permit itself.
Chapter 151 also says no tent may be erected on a property for more than 14 consecutive days. That covers install and strike as well as the event day. A rental company that wants to set up early for a holiday weekend needs to keep the whole span inside 14 days.
The tent permit rides on the special event permit, and that permit has its own clock under 151-5(B). The deadline is 21 days ahead for 1 to 75 people, 30 days for 76 to 150, 48 days for 151 to 250 and 60 days for 251 or more. File the tent application in the same window. Late filings on the special event side carry a fee of $100 to $5,000, with the per tier amounts not published in accessible form.
On Town beaches only a food service tent is allowed, and the Trustees must approve any arch
Section 151-3(C)(1)(b) permits only food service tents on beaches, unless a charitable organization sponsors the event. A ceremony tent on the sand is not on offer. The East Hampton Town Trustees, who run a separate beach event permit, require their permission for tents and arches and want a layout sketch with the application. Their fees, effective 1 May 2025, run $75 to $200 depending on the beach and on residency, and applications are due at least 21 days ahead.
The Town's page also caps a catered beach event or wedding ceremony at 50 attendees, and 151-3(C)(1)(b) bars amplified music at any beach assembly. A tent on the beach is the exception in this code, and the food service tent is the only kind it names.
The Village of East Hampton sends tents to Code Enforcement on the same 21 day clock
Inside the Village, Chapter 139 governs. Section 139-5B(6) requires a separate tent application to Code Enforcement. The special event application itself is due no less than 21 days before the event under 139-5A, and it triggers at 50 or more people including staff. A square footage threshold for the Village tent application is not published in the sections we read. Fees are set by Village Board resolution and are not printed in the code.
One point in the Village's favor for a tented reception: 139-11B allows outdoor music to be permitted until 11pm as a condition of the permit. The Town's application page lists amplified music outdoors after 9pm as a permit trigger.
Southampton's tent and beach rules sit in a document we could not open
The Town of Southampton publishes a beach permit document, CP-649, revised January 2026, in the Document Center at southamptontownny.gov. The link would not load for us. Its fees, thresholds and hours are therefore not retrieved, and we will not guess at them. Call the Town Clerk and ask for CP-649 by name, and ask separately which office handles tent permits for private property.
What we could read is the Town's noise code. Chapter 235 permits exterior amplified sound only from 7am to 7pm within the standard, with no wedding exemption. A tented reception in the Town of Southampton with a band through a PA at 9pm is outside that code. Inside the Village of Southampton, Chapter 77 allows noncommercial amplified sound from 9am to 11pm and the Board of Trustees can grant a wedding exception, both added on 11 July 2024.
Nassau County and the rest of Suffolk are outside this research
Our regulatory reading covered East Hampton Town, East Hampton Village, the Town and Village of Southampton and Fire Island National Seashore. Tent rules for the towns of Nassau County and western Suffolk are not in it. Call the building department of the town where the property sits and ask which office issues tent permits, what square footage triggers one, and how many days a tent may stand.
Eight questions for the tent rental company
The rental company has pulled these permits before, or it has not. Find out which.
- What is the exact square footage of the tent, in writing, so we know whether the 700 square foot Fire Marshal trigger applies?
- Who files the Tent Permit Application with the East Hampton Fire Marshal, you or the property owner, and when?
- What are the install and strike dates, and do they fit inside the Town's 14 consecutive day limit?
- Can you provide a certificate of insurance naming the Town at $2,000,000 per occurrence under 151-16, or naming the Trustees for a beach event?
- Can you draw the layout sketch the Trustees require for anything placed on the beach?
- Have you pulled a tent permit in this specific town or village in the past year, and can we see it?
- If the caterer cooks under the tent, does the Suffolk County Department of Health Services temporary food event permit apply? The county document we read covers multi event vendors and lists $95 for a first permit and a $70 late fee inside 14 days. It does not settle the single wedding case. The county's number is 631-852-5999.
- What happens to the deposit if the permit is denied?
